Terms & Conditions
Oh! This Old Thing?
Last updated: 8 March 2026
1. Introduction
These Terms & Conditions (“Terms”) govern your use of ohthisoldthing.shop and any purchases made from Oh! This Old Thing? (“we”, “our”, “us”).
By using our website, placing an order, or purchasing from us, you agree to these Terms to the extent they apply to that use or purchase.
Nothing in these Terms excludes, limits, or modifies any rights or remedies you may have under the Australian Consumer Law or any other applicable law.
2. Business Details
Business name: Oh! This Old Thing?
ABN: 78 693 624 117
Location: Australia
Email: info@ohthisoldthing.shop
Website: ohthisoldthing.shop
3. Website Use
You agree not to use this website:
for any unlawful, fraudulent, misleading, or harmful purpose
to interfere with the website’s operation or security
to attempt unauthorised access to our systems, data, or accounts
to copy, scrape, reproduce, or exploit website content except as permitted by law or with our written permission
We may suspend or restrict access to the website where reasonably necessary for security, maintenance, legal compliance, or misuse prevention.
4. Products & Vintage Condition
We specialise in vintage and secondhand homewares, decor, and art.
Because many of our products are vintage or pre-owned, they may show signs of age, wear, variation, repairs, or other characteristics consistent with prior use. These features are often part of the item’s nature and are not necessarily faults.
We aim to describe and photograph items as accurately as possible. Customers are responsible for reviewing all listing details, dimensions, photographs, and condition notes before purchasing.
Nothing in this section limits any rights you may have if an item is faulty, materially not as described, or does not meet applicable consumer guarantees. The ACCC makes clear that consumer guarantees continue to apply and businesses cannot rely on “no refund” style statements to avoid them.
5. Pricing & Payment
Unless otherwise stated, all prices are shown in Australian dollars ($AUD).
We may update prices at any time before an order is placed. Prices shown at checkout at the time of purchase are the prices applicable to that order, unless there is an obvious error.
Payments are processed through third-party payment providers such as Stripe and PayPal. We do not store your full credit card details ourselves.
For international orders, the customer is responsible for any customs duties, tariffs, taxes, brokerage fees, VAT, GST, or clearance charges unless expressly stated otherwise.
6. Orders & Contract Formation
Placing an order does not automatically mean the order has been accepted.
A contract is formed when we accept your order and confirm dispatch, or otherwise clearly confirm acceptance.
We reserve the right to refuse, limit, or cancel an order before dispatch where reasonably necessary, including where:
the item is unavailable
there is an obvious pricing, listing, or shipping error
we suspect fraud, misuse, or unauthorised activity
the order appears to breach applicable law or these Terms
shipping to the destination is not feasible or lawful
If we cancel an order before dispatch after payment has been received, we will refund the amount paid for that order.
7. Shipping & Delivery
Shipping, processing times, international customs charges, and delivery estimates are governed by our Shipping Policy, which forms part of these Terms.
Delivery timeframes are estimates only and are not guaranteed.
Risk in goods does not pass in a way that limits any non-excludable rights you may have under law. If an item is lost, damaged, faulty, or not as described, your rights will depend on the circumstances and applicable law.
8. Returns, Refunds & Remedies
Returns, refunds, and damaged-item processes are governed by our Returns & Refunds Policy, which forms part of these Terms.
We do not accept change-of-mind returns unless we choose to do so in an exceptional case or are required to do so by law.
If goods are faulty, materially not as described, incorrect, or otherwise fail to meet consumer guarantees, you may be entitled to a remedy under the Australian Consumer Law or other applicable law. The ACCC states that remedies can include repair, replacement, refund, cancellation, or compensation depending on the nature of the problem.
We do not use any policy wording to limit those non-excludable rights.
9. International Customers
If you purchase from outside Australia, local import rules, taxes, customs procedures, and mandatory consumer protections in your country may apply.
These Terms do not exclude any non-waivable consumer protections that apply under applicable law.
Customers are responsible for checking whether goods can be legally imported into their destination country and for paying any import-related fees unless expressly stated otherwise.
10. Intellectual Property
Unless otherwise stated, all content on this website - including text, product descriptions, graphics, branding, logos, photographs, layouts, and design elements - is owned by or licensed to us and is protected by intellectual property laws.
You must not reproduce, distribute, republish, adapt, or commercially exploit website content without our prior written permission, except as permitted by law.
11. Accuracy of Website Content
We try to ensure that website content is accurate, current, and complete. However, mistakes can occur, including in product descriptions, prices, shipping details, availability, or images.
To the extent permitted by law, we reserve the right to correct errors, update information, and cancel or refuse orders affected by obvious mistakes before dispatch.
Nothing in this section limits any rights you may have where goods supplied are faulty, materially different from what was purchased, or otherwise fail to meet consumer guarantees.
12. Liability
To the maximum extent permitted by law, we exclude liability for indirect or consequential loss arising from use of the website or from goods purchased through it.
Nothing in these Terms excludes, restricts, or modifies liability for:
consumer guarantees under the Australian Consumer Law
fraud
misleading or deceptive conduct
any other liability that cannot lawfully be excluded
Where liability cannot be excluded but can be limited, our liability is limited to the maximum extent permitted by law.
This kind of careful carve-out matters because the ACCC is focused on unfair terms and retailers cannot contract out of statutory consumer protections.
13. Privacy
Your use of the website is also governed by our Privacy Policy and Cookie Policy, which explain how we collect, use, and handle personal information.
14. Third-Party Services & Links
Our website may use or link to third-party services, platforms, or websites, including payment providers, shipping services, analytics tools, or social platforms.
We are not responsible for the content, terms, or privacy practices of third-party websites or services, except to the extent required by law.
15. Governing Law
These Terms are governed by the laws of New South Wales, Australia.
You and we submit to the non-exclusive jurisdiction of the courts of New South Wales and any courts entitled to hear appeals from them, subject to any rights or remedies you may have under applicable consumer laws.
“Non-exclusive” is the safer consumer-facing wording here than trying to box everyone into a one-way venue clause.
16. Changes to These Terms
We may update these Terms from time to time to reflect changes in the law, our business operations, our website, or our policies.
The latest version will be posted on this page with the updated “last updated” date.
